These Terms and Conditions ("Terms") govern your access to and use of the SAKU mobile application and related services (the "Platform"), operated by FLYSUN PTY LTD ("we", "us", "our"). SAKU is a business name of FLYSUN PVT LTD.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Platform Role
SAKU operates as an online marketplace platform that connects customers seeking services with independent third-party service providers ("Vendors"). SAKU does not provide services itself and is not a party to any agreement between a Customer and a Vendor.
2. Definitions
- Customer: A user who books services through the Platform.
- Vendor: An independent service provider offering services through the Platform.
- Booking: An on-demand service appointment requested by a Customer and accepted by a Vendor.
- Commission: The service fee charged by SAKU, currently 10%, for use of the Platform.
3. Eligibility
- You must be 18 years or older to use the Platform.
- Vendors confirm they have the legal authority, licences, registrations, and insurance required to provide their services.
4. Account Registration
Users must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login details.
We reserve the right to suspend or terminate accounts that provide false or misleading information.
5. Bookings and Services
- Customers may request on-demand services through the Platform.
- Vendors may accept or decline booking requests.
- Any service contract is solely between the Customer and the Vendor.
SAKU does not supervise, manage, or guarantee the quality, safety, or legality of Vendor services.
6. Fees and Commission
SAKU charges Vendors a 10% commission on completed bookings. The commission is deducted through the Platform in accordance with the payment process in place at the time of the booking.
We reserve the right to change commission rates with reasonable notice.
7. Payments
Payments for services are processed through the Platform unless otherwise stated. SAKU facilitates payments only and does not hold funds as a trustee or provide escrow services.
8. Cancellations and Refunds
Cancellations and refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms.
9. Vendor Responsibilities
Vendors are responsible for:
- Providing services professionally and lawfully
- Holding required licences and insurance
- Ensuring accuracy of service listings
- Complying with all applicable laws and regulations
10. No Employment Relationship
Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship between SAKU and any Vendor.
11. User Conduct
Users must not:
- Misuse the Platform
- Circumvent the Platform to avoid commission
- Engage in unlawful, fraudulent, or harmful conduct
12. Intellectual Property
All Platform content, branding, and software are owned by FLYSUN PTY LTD. Vendors grant SAKU a licence to display their business names, logos, and content on the Platform.
13. Limitation of Liability
To the maximum extent permitted by law, SAKU is not liable for any loss, damage, or dispute arising from services provided by Vendors.
14. Platform Availability
We do not guarantee uninterrupted access to the Platform and are not liable for outages, maintenance, or technical issues.
15. Force Majeure
We are not responsible for failure or delay caused by events beyond our reasonable control.
16. Termination
We may suspend or terminate access to the Platform at any time for breach of these Terms.
17. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia.
